About the seminar topic

The last few years have witnessed increasing recognition of the importance of human capital management as part of the firm’s corporate purpose. This has led to the emergence of human capital management disclosure and the management of human capital risks under the ESG framework. What has heretofore been within the remit of labour law has become a feature of corporate law and finance, as part of the ‘S’ in ESG. These developments merit an examination of sustainability as a legal concept in the context of the relationship between capital and labour. What does sustainability entail where human capital (or labour) is concerned? In this light, this paper compares the divergent approaches between the EU and US towards human capital management in the ESG framework to distinguish between different conceptions of sustainability, and, in turn, the management of sustainability risks with respect to human capital as part of the corporate purpose.
